TERMS AND GENERAL CONDITIONS

Booking; Check-out

When you book the apartment you agree to pay all charges for your reservation, including applicable charges such as service charges, offline charges, taxes, and any other items identified during the payment process (collectively, the "Total Price"). When you receive your booking confirmation, a contract for the Root Comfort Apartments Services is entered into. In addition to these Terms, you will be subject to and responsible for complying with all terms of the Reservation, including, without limitation, cancellation terms and any other rules, standards, policies or requirements identified on the site or during the payment process that apply to the Reservation. It is your responsibility to read and understand these rules, standards, policies and requirements before you book the apartment.

Booking an apartment constitutes a limited license to access, occupy and use that apartment. If you stay in the apartment beyond the check-out time, Radice Comfort Apartments has the right to make you leave in accordance with applicable law, such as imposing reasonable penalties for overstaying. You may not exceed the maximum number of Occupants allowed.

 

A. Minimum Age.

The minimum age for renting the Property is the age specified in any Unit Specific Terms. If no age is specified in the Unit Specific Terms, the minimum age is 18. You agree to provide us with proof of age upon request. A parent or legal guardian must accompany all guests under the minimum age for the entire duration of the rental.

 

B. Responsible Renter.

As a Renter, you agree to be an Occupant of the Property for the entire duration of the rental. All other Occupants must be authorized by Root Comfort Apartments and will be family members, friends, other responsible adults over the minimum age or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all Occupants, and possibly guests and invitees present at the Property at any time during your stay, and to ensure that all Occupants understand and abide by the Terms.

  

C. Good Neighbor Policy.

Since the Property is a privately owned home, all Occupants must abide by this good neighbor policy. Please treat the Property with the same care you would use with your residence and leave it in the same condition as it was when you arrived. To prevent theft or damage to furnishings or personal property, you agree to close and lock doors and windows when you are not present in the Property and at check-out. You and the other Occupants agree to behave during your stay in a manner that is respectful and not harmful to neighbors, traffic flow, or the community, and not to elicit complaints to Root Comfort Apartments from police, neighbors, or neighborhood associations or homeowners. Audible noise outside the property is prohibited between 10:00 pm and 8:00 am.

 

D. Maximum Occupancy.

The number of persons present at the Property may not exceed the published maximum occupancy. You may not allow any person to participate in a Root Comfort Apartments service unless that person is included as an additional guest during the reservation process.

 

E. No Smoking.

Smoking is not permitted inside the facility at any time.

 

F. No Permanent Residence.

You agree that your use of the Property is only on a temporary and transient basis; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than on the Property.

 

G. Animals.

No animals or pets of any kind are allowed on the Property, except (1) as specifically authorized on the reservation or (2) bona fide service animals that we are required by law to allow. Emotional support animals are not allowed except as authorized pets. You agree that an animal ban is not a guarantee that an animal has not been inside the Property or that the Property is free of animal or pet allergens.

 

H. Commercial Events and Photography; Prohibitions.

Events and commercial photography or filming are prohibited at the Property without our express written permission. (If approved, additional conditions and fees may apply.) No tents or other structures may be erected on the property without our express written permission. The use of charcoal grills is not permitted.

 

I. Criminal activity prohibited

Use of the Property for any criminal activity is prohibited and may result in fines, prosecution, and/or immediate removal from the Property. This prohibition extends to the use of the Property's Internet service, if any, for criminal activity, including but not limited to illegal downloads of copyrighted material, including movies, music, software, or other material. We may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay.

 

J. Payment Terms; Fraud.

If you are paying by credit card, you represent that you are the account holder or an authorized user of the account. If for any reason Root Comfort Apartments believes that your payment may be declined by the card processor, the Property may ask you for a different form of payment. Upon Radice Comfort Apartments' request, you will immediately provide another form of payment and adequate proof that you are the account holder or an authorized user of the account used for payment (such as a government-issued ID that matches the name on the account). Root Comfort Apartments may cancel your reservation or immediately remove you and all occupants from the Property if you do not provide a form of payment that can be validated by the Property. We may share your credit card information and other information about you with law enforcement if we suspect fraud.

 

K. Consequences of Violation; Damage Charges.

Any failure by you or any other Occupant to comply with any of the above terms, conditions or policies constitutes a breach of this Agreement and may result in the loss of your rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement. Root Comfort Apartments may terminate this Agreement for breach and, if you are notified of such termination, you agree to vacate the Property immediately.

 

 You are responsible for leaving an Accommodation (and related personal property) in the condition it was in upon your arrival, you are responsible for payment of all amounts arising from claims and necessary to make good any damage you and all Occupants as well as your guests have caused to an Accommodation, all Occupants are responsible for treating others with respect and following applicable laws at all times.

 

ADDITIONAL TERMS AND CONDITIONS

 

L. Cancellation Policy.

Unless otherwise stated in the house description and unit-specific terms, reservation payments are fully refundable (less the amount of the Root Comfort Apartments reservation fee, which is earned upon receipt and becomes non-refundable 24 hours after booking) for cancellations received 30 or more days prior to the first night of your reservation. No full or partial refunds will be given for no-shows or for cancellations less than 30 days before the first night of your reservation, arrival after the first night of your reservation, or departure before the last night of your reservation. Except as expressly provided in this Agreement, no refunds or compensation will be given and Radice Comfort Apartments will not be liable to you for failure to make the property available for occupancy if the property is unavailable or becomes partially or totally unusable for any reason beyond the control of Radice Comfort Apartments, including, but not limited to, adverse weather conditions, natural disasters, mechanical failures, evacuation orders or other acts of government agencies, or utility outages. Root Comfort Apartments recommends that guests obtain adequate and comprehensive travel insurance covering the Renter and all Occupants and including coverage for personal injury, sickness or disease, and property damage or loss.

M. Travel Insurance. Root Comfort Apartments recommends that guests obtain adequate and comprehensive travel insurance that covers the Renter and all Occupants and that includes coverage for personal injury, illness or disease, and damage or loss to property, and to help protect against financial loss if it is necessary to cancel the reservation for a covered reason.

N. Early check-in/Delayed check-out.

Early check-in or late check-out may be available; additional fees may apply. If you do not vacate the Property by the check-out time (or the late check-out time as agreed upon by Root Comfort Apartments), you authorize us to charge your credit card on file a late departure penalty up to a maximum of one night's rental and we may remove all occupants and their personal property from the Property.

O. Maintenance or cleaning problems; Property conditions.

The Property is provided as is and we are not responsible for the inoperability or unavailability of any services. You agree to contact Radice Comfort Apartments, using the contact information provided in the confirmation email, as soon as you notice any maintenance or cleaning problems, or any potentially dangerous conditions, at the Property, or if an incident occurs at the Property related to such a problem or condition. You also agree to allow Root Comfort Apartaments a reasonable amount of time to respond to your report and to cooperate with the Property's efforts to address the problem or provide a

remedy. We will take reasonable and appropriate steps to remedy any reported problem as soon as possible. We may enter the Property at your invitation to remedy any reported problem, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property and to address any situation that we reasonably believe is an emergency that threatens persons or property. However, Root Comfort Apartaments reserves the right to access the Accommodation during your stay, to the extent that this is: reasonably necessary, permitted under our contract with the Property, and in accordance with applicable law.
